Legal, sources and privacy

The plain-language terms behind everything Waymark Index publishes and sells.

1. Opinion, not advice

Waymark Index publishes general research and commentary on public planning and energy records. It is not financial, legal or investment advice, and it does not take your objectives, financial situation or needs into account. Before you act, consider whether it suits your circumstances and get professional advice where appropriate.

Calls and WCI ratings are opinions held at the date shown. They can change as the record changes. A WCI rating is not a forecast and not a rating of a developer, a company or a site. Facts are referenced to their sources. Opinion is labelled as opinion, and estimates are marked with their assumptions.

2. Sources policy

  • Official records first: planning portals, agency advice, notices and consents; network-operator and market-operator publications; government pages. Company announcements are reported as the company's own claims.
  • Secondary sources (press, law-firm briefings, trackers) are used only where official records weren't reachable, and are labelled as secondary. Press repeating the same source doesn't count as corroboration.
  • Cite and summarise. We link to sources rather than redistribute them, quote briefly, and never copy press articles in full. Public access to a document doesn't mean unrestricted reuse.
  • Every fact in a brief carries a reference to a row in our source table, with the document, link, access date and grade.
  • We name companies and public bodies, never private individuals. Officers named in agency letters are not identified.

3. Right of reply, corrections and concerns

Before we publish an excerpt that assesses a developer's project (a verdict, call or rating), we offer that developer a right of reply and summarise its response. Projects that appear only in a factual status line are not part of this step. A reply changes a call or rating only through new evidence or a factual correction.

If you think something we published is wrong, email riette@waymarkindex.com with "Correction" or "Concerns notice" in the subject. We reply within 7 days. Where the evidence supports it, we issue a correction, qualification, update or retraction, log it in our corrections log, and link every later issue to the call it changes.

4. Privacy (POPIA and the Australian Privacy Principles)

Waymark Index is a trading name of Riëtte Crowther, a sole proprietor in South Africa. It is not a registered company. Its handling of personal information is covered by South Africa's Protection of Personal Information Act 2013 (POPIA). For Australian contacts, we also follow the Australian Privacy Principles (APPs) as our standard of practice.

Responsible party and information officer: Riëtte Crowther, 5a Jan Bam Street, Pellissier, Bloemfontein, 9301, South Africa, riette@waymarkindex.com

What we collect, and why

  • Email correspondence you send us, and your name, role, organisation and email address, so we can reply and supply what you ask for.
  • Billing details needed to issue and reconcile invoices, such as organisation name, address, tax or purchase-order references.
  • Business contact details published by organisations for a relevant role, used only to send a single, relevant business email. We record where and when each address was published.

What we don't do

  • This website uses no cookies, analytics, tracking pixels, advertising tags or third-party scripts. Our emails contain no tracking pixels.
  • We don't sell, rent or share personal information for anyone else's marketing.

Service providers

Email is hosted by Zoho Mail, in its United States data centres; the site is served by Cloudflare's global network. Cloudflare may process technical data such as IP addresses to deliver and secure the site. These providers may store data outside South Africa and Australia. Payment and invoicing providers will be listed here before we take any payment.

Keeping and correcting your information

We keep correspondence and billing records for as long as we need them for the purpose they were collected for, or as tax law requires. You can ask to see, correct or delete your personal information, or object to our use of it, by emailing riette@waymarkindex.com. If you're not satisfied with our response, you can complain to the Information Regulator (South Africa) or, in Australia, you may be able to complain to the OAIC (Office of the Australian Information Commissioner).

5. Email and opting out (Spam Act 2003)

We send business emails only to addresses an organisation has conspicuously published for a relevant role. We never guess addresses or use bought or scraped lists. We send one approach per person, and follow up only if you reply.

Every email we send identifies the sender (Riëtte Crowther, Waymark Index, riette@waymarkindex.com) and includes a way to opt out: reply 'stop' or 'unsubscribe' and we won't write again. Opt-outs are honoured within 5 working days. You can also opt out at any time by emailing riette@waymarkindex.com with "Stop" or "Unsubscribe" in the subject.

6. Terms of sale and licence

  • Scope and delivery. Each offer's scope is stated in writing before purchase, and everything is delivered in writing by email. We don't offer calls or meetings.
  • Prices are published on our home page, in US dollars, with the Australian-dollar equivalent shown on invoices. Founding rate until 31 Mar 2027, first 5 organisations, standard rate from 1 Apr 2027.
  • Payment. Payment is by bank transfer; details are on each invoice. We will never change our bank details by email. Check any change with us in writing before you pay. Invoices are payable within 14 days.
  • All sales are final after delivery. This doesn't limit any rights you have under law that can't be excluded.
  • Who you are buying from. Waymark Index is a trading name of Riëtte Crowther, a sole proprietor in South Africa. It is not a registered company. Contracts and invoices are with Riëtte Crowther, trading as Waymark Index.
  • Licence. Paid briefs are licensed to the buying organisation for internal use and are not for redistribution. Ratings are opinions at the date shown. © 2026 Riëtte Crowther.
  • Independence. Waymark Index has no developer clients and takes no payment from projects it covers. Buying a brief never changes a call or a rating.
